On March 12, 2025, U.S. Education Secretary Linda McMahon issued a letter warning SJSU and CSU of potential enforcement actions, including federal funding suspension or referral to the Department of Justice, if no resolution is reached within 10 days.[3][5]
During the board meeting at CSU's Long Beach headquarters, speakers including alumni, students, and activists debated the issue. Pro-transgender speakers expressed support for the lawsuit, while "save women's sports" advocates criticized it as enabling harm to female athletes. SJSU competes in NCAA Division I as part of the Mountain West Conference. The volleyball program faced national scrutiny in 2024 after Fleming's participation in the conference tournament, where SJSU reached the final.[4][5]
